Which of the four forms do you need?

Texas prescribes the exact language: a lien waiver is unenforceable unless it substantially complies with the statutory form (§53.284(a)). That's actually good news — you don't negotiate waiver language in Texas, you just pick the right form of the four.

The one distinction that matters is conditional vs. unconditional. A conditional waiver only takes effect once the check clears — it's the safe one to hand over at the moment you're getting paid. An unconditional waiver takes effect the moment you sign it and states you've already been paid — never sign one before the money has actually cleared. Texas law prohibits anyone from requiring an unconditional waiver from a party that hasn't been paid, which is why those two forms carry a bold warning notice on their face.

Progress vs. final is simpler: progress forms cover one payment along the way (retainage and later work stay protected); final forms wrap up the whole job.

Do waivers need to be notarized?

Not anymore, for most jobs — the notarization requirement was removed for prime contracts signed on or after January 1, 2021. On older contracts it still applies, so the generator can add the notary block when you need it.
